  • Changes to the immigration rules from 29 November 2010 introduces the the English language requirement for spouses and civil partners. Contact us for advice on these changes and how they might affect you.

 

  • The changes also reverse  the Supreme Court decision in ZN. Paragraphss 352A-FJ are amended from 22 October 2010 so that a grant of British citizenship automatically revokes refugee status.  Thus only sponsors currently "refugees granted status as such under Immigration Rules" may benefit from family reunion provisions.  They lose the right to family reunion once they become British citizens and will need to fulfil the requirements of the Immigration rules. These changes provide a very narrow window for applications. Contact us for advice. 
  • If you have been refused an application for leave to enter or remain under Tiers 1,2,4 or 5 of the PBS or lost an appeal under the PBS on the sole ground of maintenance you can apply for a review under the terms of the judgment in Pankina [2010] EWCA Civ 719.
